Pet Purchasing Agreement

The Seller will prepare all reasonable and required registration, vaccination, and health documents.

SELLER’S OBLIGATIONS:

1. The Seller will have lovingly raised this Cat, ensuring good health, proper socialization, and good temperament, in a free-room home environment free of cages, constraints, smoke, or any cruelty. Our kittens are never caged; they typically cohabitate in nesting boxes or playpens from when they are little until they are about five weeks old. 

2. The Seller has carefully selected the parentage of this Kitten for optimum health, temperament, beauty, and personality. Upon request, the Seller will provide the Buyer with a copy of its ancestors’ pedigree and TICA or CFA registration papers in a timely manner with additional cost.

3. Cat’s Health Guarantee

3.1. Seller guarantees this Cat/Kitten is in good health, free of feline leukemia, feline immunodeficiency viruses, and any other major infectious diseases to the best of the Seller’s knowledge at the time of sale. The kitten is guaranteed without genetic diseases for 12 months. If the Kitten/Cat should die or be destroyed within these time limits from genetic diseases, the seller will replace the Kitten/Cat upon being provided an autopsy report. This guarantee becomes void if this Kitten is given a FIP (Feline Infectious Peritonitis), FeLV, FIV, Giardia, or ringworm vaccination. This kitten will have been dewormed and had 1 (one) or 2(two) kitten shots, known as 3-way kitten FVRCP boosters. The seller agrees to provide a complete record of all deworming and vaccinations for this kitten/cat. The seller recommends that only one vaccine be given per visit to the vet and not in combination with any other vaccinations. The seller also does not guarantee the kitten against any adverse reactions to future vaccinations or veterinary care.

3.2. Seller guarantees the Cat/Kitten is free of any hereditary malformations (genetic defects) to the best of the Seller’s knowledge at the time of sale. In the event a fatal genetic defect is found and confirmed in the Cat/Kitten by a practicing veterinarian within a year from the date of the purchase, the Seller agrees to replace the Cat/Kitten with another Cat/Kitten of equal value or better when one becomes available, assuming that the Seller was notified in writing of the health issues at the time they occurred. A necropsy report with an explanation by the Cat/Kitten’s attending veterinarian must be provided to the Seller prior to the replacement Cat/Kitten being given to the Purchaser. Common cold/URI is not covered under this health guarantee. No money will be refunded to the Buyer in case of the Kitten’s demise. No replacements if the kitten is hurt by a dog or child.  The health cannot be guaranteed if the kitten is around other cats allowed outside. Seller will assume no responsibility for diagnostics, treatment, veterinary costs, veterinary certification, shipping costs, nor any other expenses associated with situations arising from Cats/Kittens hereditary malformations.

3.3. The Seller will have completed all of the age-appropriate vaccinations and all health care up until the Kitten has been shipped to or picked up by the Buyer. A copy of the kitten's health record will be provided to the Buyer at the time of purchase. At that time, all health care will become the responsibility of the Buyer, and the Seller is not responsible for any veterinary expenses. The seller will not be responsible for any shipping cost.

3.4. The seller provides a 72-hour limited warranty that the above Cat/Kitten is in good health at the time of pick up/shipping. (Details of the limited warranty are outlined in the Buyer Obligations Section 1)

4. Seller assumes no responsibility for purchaser’s allergies to cats, disapproval of landlord or family members, lack of proper house training for this cat/kitten, etc. No monies will be refunded for these or any other reasons.

5. Seller may initiate legal action against the Buyer if this Cat/Kitten is found to have been neglected by the Buyer, or is in ill health for an unreasonable length of time, or without proper care or cruelly treated, or if the Buyer does not abide by the terms of this contract in the Seller’s opinion.

6. If, for any reason, the Buyer cannot keep the kitten/cat, the kitten/cat must be returned to Lapdolls Cattery. If the kitten/cat is ever returned or surrendered back to Lapdolls Cattery for any reason, except for a problem covered with a Health Guarantee, no refunds will be given to the Buyer.

 

BUYER’S OBLIGATIONS:

1. The Cat/kitten is in good health and free of communicable diseases at the time of this sale. Buyer agreed that they shall have 72 hours from the delivery date to have the Cat/kitten examined by a licensed veterinarian at Buyer’s sole cost. For a period of 14 (fourteen) days, Kitten/Cat must be guaranteed from other pets.

If the Cat/kitten fails the examination within that time frame, the Buyer may return the Cat/kitten, with a written statement from the veterinarian, for a full refund. 

Failure by the Buyer to have the Cat/kitten examined within the 72-hour period will nullify this warranty.

If the Buyer chooses to keep the Cat/kitten, no replacement will be given, and all medical costs and treatment are the Buyer's sole responsibility. This health guarantee will be null and void, and no further health guarantee will be given or honored.

Any necessary treatment or other expenses are the responsibility of the Buyer. All health-related decisions and expenses are the responsibility of the owning party. (No refunds will be given). Upon pick-up/arrival, the Cat/Kitten must be quarantined to prevent contact with any other pets in the house until the Cat/Kitten has been thoroughly examined by a veterinarian. Failure to quarantine, causing exposure to other pets, will void the health warranty. If the veterinarian finds any physical problems that make the veterinarian think the Cat/Kitten is a poor health risk, the veterinarian should write and sign a note on his/her letterhead stationery, explaining his/her findings within the first 72 hours after pick-up.

2. The Buyer agrees to provide the Cat/Kitten with a clean, pleasant environment, conducive to good health and longevity and with adequate space for exercise. At least one litter box will be provided for each cat in the household and will be cleaned daily. The Cat/Kitten will be kept un-caged for the main duration of its life. The Buyer will provide the Cat/Kitten with fresh water available at all times, proper nutrition in the form of food that is healthful and balanced for a feline, and a scratching post at minimum. The Buyer will provide the Cat/Kitten with proper veterinarian care, vaccines, companionship, and exercise.

3. The Buyer will not let the Cat roam outdoors. Letting the Kitten/Cat roam outdoors puts this animal in jeopardy of attack or of coming in contact with sick animals and other dangers and violates this contract, thereby avoiding the warranty. If the Cat/Kitten is found to be kept in an unsuitable environment, being neglected, or is poorly cared for, the Seller will reserve the right to request that the Cat/Kitten be immediately and unconditionally returned at no cost to the Seller with NO REFUND of purchase price and/or the Seller may initiate a legal action against the Buyer.

4. Under no circumstances will this Cat/Kitten be sold, leased, donated, or given to any pet shop, research lab, or similar facility.

5. Under no circumstances will this Cat/Kitten be leased, loaned, sold, or given to another cat breeder.

6. The Buyer agrees that this Cat/Kitten will not be declawed. Guarantees become null and void if the declawing procedure is done.

7. The Buyer understands and agrees that this Cat/Kitten is being sold as a pet only and NOT for breeding.

8. The Buyer agrees to return the Cat/Kitten to the Seller if circumstances beyond the Buyer’s control occur that would prevent the Buyer from continuing to provide a satisfactory level of care and ensure the lasting well-being of the Cat/Kitten regardless of the Cat’s age. The Buyer will return the Cat/Kitten at Buyer’s expense, and no refund will be issued to the Buyer in this case.

9. The Buyer agrees to feed the kitten/cat Life`s Abundance food at least until the kitten/cat is on the health guarantee term (16 months from the update). Pick up on ______________Buyer’s Initials: ____________________

 

LONG-TERM HEALTH CARE, LIMITATIONS OF LIABILITY, LEGAL PROCEEDINGS, PUBLICITY

AND CONTRACT VARIATIONS:

 The Seller will not be held liable for any veterinary, health care, inspection, registration, transportation, or any other costs occurring while the Cat/Kitten is in possession of the Buyer, except as provided for by the limited warranty above.

The Seller's maximum liability to the Buyer for any and all losses, claims, damages, or liability of any kind shall be limited to the amount paid by the Buyer to the Seller under this agreement. Any expenses for health care request of the Seller by the Buyer in fulfillment of the Seller’s limited warranty obligations will be paid at the discretion of the Seller. If the Buyer fails to comply with any aspect of this agreement, the Buyer may forfeit any rights the Buyer may otherwise have.

This Agreement shall be governed by and construed in accordance with the laws of Washington. If a conflict between the Buyer and the Seller arises that cannot be resolved in an amicable way and legal proceedings become necessary, the Buyer agrees that all legal and/or court procedures take place in the city of Vancouver, Washington, utilizing Clark County Superior Court Arbitration, and proceed under Mandatory Arbitration Rules. Seller shall be entitled to attorney fees and costs associated with any such litigation.  

Heirs and Assigns. All rights, remedies, and liabilities herein given to or imposed upon the parties hereto shall inure to the benefit of and bind their heirs, executors, administrators, and successors.

Entire Agreement

 This Agreement, consisting of this instrument and any Exhibits referred to herein, all of which are incorporated herein by this reference, contains the entire understanding of the parties regarding its subject matter and supersedes all prior and contemporaneous negotiations and agreements, whether written or oral, between the parties with respect to its subject matter. The language in all parts of this Agreement will, in all cases, be construed according to its fair meaning and not strictly construed for or against either of the parties. Without limitation, there will be no presumption against any party on the ground that the party was responsible for drafting this Agreement or any part of it. The titles and subtitles used in this Agreement are used for convenience only and are not to be considered in construing or interpreting this Agreement. This Agreement may not be modified in any manner whatsoever except by a written instrument signed by both parties.

 Force Majeure

The parties shall be excused from liability for the failure or delay in performance of their obligations under this Agreement by reason of any event beyond a party's reasonable control, including but not limited to Acts of God, fire, flood/water inundation (other than water delivery pipes or conduit failure due to ordinary aging or freezing), explosion, earthquake, acts of war or terrorism, civil unrest, military disturbance or nuclear catastrophe. Such excuse from liability shall be effective only to the extent and duration of the event(s) causing failure or delay in performance, provided that a party has not caused such event(s) to occur. Notice of a party's failure or delay in performance due to force majeure shall be given to the other party within five (5) calendar days after its occurrence. In the event of a force majeure that persists for one hundred eighty (180) days or more, then either party may terminate this Agreement upon written notice to the other party.

 If a disagreement or legal proceedings occur between the Seller and the Buyer, the Buyer is prohibited to discuss any details of the disagreement or legal proceedings with anyone by any means outside of those directly involved.

The Buyer agrees that Seller may, at her own discretion, request periodic status updates and/or photographs from the Buyer of the Cat/Kitten in its new life environment to ensure the wellbeing of the animal. Seller, at its own discretion, may use the provided materials for publicity.

 In case of a breach of the Agreement, the Purchaser agrees to deliver this Cat/Kitten and its prodigy to the Seller at Buyer’s expense, execute and pay for registration (TICA, CFA, as appropriate) paperwork to transfer ownership back to the Seller.

By signing below, the Buyer(s) and the Seller indicate that they have read, agree to, and adhere to the conditions stated herein and are in full agreement with all of the above provisions and conditions of the contract.
